uOttawa Carpool Website Privacy Statement

1. Collection: University of Ottawa and/or RideShark Corporation (“we” or “us”) gathers various information about users of the rideshare Website and the rideshare program available on that site (the “Website”). This information includes: (a) personal information, provided through voluntary registration; (b) personal information regarding your use of the Website, including but not limited to the identity of people who you are matched with by the Website and the content of any messages that you send to another person using the Website; (c) personal information, provided to us by you through any other method (including without limitation correspondence and discussions); (d) personal information collected by us through click tracking in relation to your use of the Website, including the content you access; (e) aggregated data, which tracks traffic to the Website; and (f) cookies, which are pieces of information transferred to your computer hard drive for record keeping. You further authorize us to collect personal information about you from any public source. The personal information collected will be held by us or on our behalf by such other agent as we may appoint from time to time.

2. Purposes: The personal information you provide will be used for the following purposes: (a) verification of your identity and assisting you in case you forget your password or login details for use of the Website; (b) to allow you to use the Website and to match you with potential rideshare partners; (c) to provide you with further information about the Website or other services offered by us or which we consider may be of interest to you; (d) to keep the Website relevant and of interest to users; (e) to respond to any requests for information made by your employer; (f) to investigate any complaints relating to misuse of the Website or misconduct in relation to rideshares organized directly or indirectly through the Website and to take any action we deem necessary to protect the safety of yourself and others in relation to those complaints; and (g) analysis in aggregate form (identifiable characteristics removed so that you will remain anonymous).

3. Disclosure: You agree that University of Ottawa or RideShark Corporation may disclose:

(a) the following personal information to potential rideshare partners to enable you to contact each other;

a. first name

b. email

c. phone number(s)

d. gender

e. whether or not you are a smoker

f. your commuting origin, destination and schedule for the trip for which you have requested a rideshare.

(b) personal information about you to your employer by giving them access to your account;

(c) your personal information to your employer where you have been misusing the Website;

(d) personal informationabout you to your employer, the police or other government authorities where we believe it is reasonably necessary to protect your safety or the safety of other people you have been ridesharing with where these rideshares have been organized directly or indirectly through the Website.

(e) your personal information to third parties when we believe in good faith that we are required to do so by law; and

(f) aggregate information and other information that does not personally identify you to such third parties as we may see fit.

With the exception of disclosures listed in 3(a)-(f) above University of Ottawa or RideShark Corp. will not share or sell any personal information about you to outside entities.

4. Consequences of non-provision of information: Failure to provide necessary personal information requested at the time of registration for or use of the Website may result in certain services not being available to you.

5. Security: We are committed to your privacy and strive to protect the personal and confidential information of those who use our Website. However, as no data transmission over the Internet can be guaranteed to be completely secure, we cannot ensure or warrant the security of any information you transmit or receive through the Website. These activities are conducted at your own risk.

How do I delete my account?

You can delete your account any time. When you delete your account, we delete things you have posted, such as your photos and trip profiles. If you do not want to delete your account, but want to temporarily stop having people find you for matches, you may set your profile to a visibility status of ‘No One’. To delete your account, simply click on Edit My Personal Info, select the Account option, and then Delete Account. Keep in mind that information you have shared with others is not part of your account and will not be deleted when you delete your account. This information includes communications, match requests or completed carpool details.

RideShark Privacy Policy

RideShark Corporation (“RideShark”, “we”, “us” or “our”) provides various ridesharing products and services, including the RideShark commute management online service, the gobyRIDE ridesharing platform made available through the gobyRIDE.com website (the “Website”), and our mobile application(s) (the “App”) (collectively, the “Services")

This privacy policy (the “Policy”) outlines how we collect, use, disclose, manage and safeguard your personal information.

For the purposes of this Policy, “personal information” means information about an identified or identifiable individual, excluding business contact information.

We will collect personal information from you when you access and use the Services. By accessing or using the Services, you are agreeing to the terms of this Policy.

We will collect information from you when you access or use the Services, including when you register for an account (“Account”) with us. We will also collect personal information that you provide to us in connection with the Services and in correspondence with us.

Registration and Account Information

When you create an Account with us we will collect certain information from you, including:

  • first and last name
  • mailing address (including city, province/state and post code)
  • origin address
  • destination address
  • email address
  • phone number
  • mobile number
  • demographic information (gender, etc.)
  • Travel schedule
  • Travel mode preferences
  • smoking status

 

You may decide to integrate your Account with a social media service. In connection with such integration, you authorize us to collect certain information that you have provided to the social media service, including your profile information, as well as any information that you make publicly available on or through the social media service. By using these social media services to interact with the Services, we are not given access to your login credentials, user name, password, or any information you may provide directly to these applications. You are strongly advised to review the privacy policies of any third-party applications you use to interact with the Services.

Payment Information (if available)

When you make or receive a payment through the Services, we will collect your credit card, debit card or banking information and other financial data. However, we do not store this payment information. We use a third-party payment processor (e.g., Stripe or PayPal, etc.) to process all payments. The use and storage of payment information is governed by the payment processor’s applicable terms of service and privacy policy.

Third-Party Information

When you use the Services, we may collect information of third-parties that you provide to us or authorize us to collect, including the personal information of your friends or colleagues (“Third-Party Data”). You are responsible for obtaining the necessary consent for the collection and use of Third-Party Data and for the disclosure of this data to us.

Log and Website Information

When you access and use the Services, we may automatically collect certain technical information about your visit, including the date, time, browser type, your internet service provider, your IP address, device information (including device identifiers), geo-location information, computer and network performance data, the URL that you are coming from and your navigation history in order to customize and personalize your experience on the Services, improve the Services and for statistical research purposes.

Location Information

The Services will collect geo-location information, including your commuting origin and destination, and will access and use the precise geo-location of mobile devices running the App. This location information is used to facilitate ridesharing on the Services. The App will only access and use your mobile device’s location information if you give the App permission through your device settings or the App.

This app collects location data to enable the “Live Track” feature even when the app is closed or not in use. We collect location data only with express permission from you and do not share or sell your location data.

We will use your personal information to provide, maintain, and improve the Services, to learn about our user base and for marketing and advertising purposes.

Identification and Verification

We will use your personal information to verify your identity and the information that you provide to us.

Account Administration

We may use your personal information to communicate with you about the Services and your Account and to provide you with technical support.

Marketing and Advertising

We may use and disclose your personal information for advertising and marketing purposes, including interest-based advertising.

Rideshare Partners

We will disclose the following personal information to potential rideshare partners to enable you to connect with each other:

  • first name
  • gender
  • whether or not you are a smoker
  • publicly available social media content
  • your commuting origin, destination and schedule for a trip that you have requested on the Services.

The commuting origin and destination will be displayed on a map with zoom levels adjusted to not allow zoom to the house level. Exact street addresses will not be revealed by the system.

Reward Partners

We may disclose your personal information to potential reward partners.

Employers

We may disclose your personal information to your employer where your employer facilitates your access to the Services.

Third-Party Service Providers

We may transfer your personal information to a third-party service provider for processing and storage. Whenever we engage a third-party service provider, we ensure that the information is properly safeguarded at all times at a comparable level of protection the information would have received if it had not been transferred.

We may transfer your personal information to a third-party service provider outside of Canada. In the event that your personal information is transferred outside of Canada, the government, courts or law enforcement or regulatory agencies of that jurisdiction may be able to obtain disclosure of your personal information through the laws of that jurisdiction.

Legal Issues

We may use your personal information to detect, investigate, address and prevent fraudulent or illegal activities. We reserve the right to disclose your personal information as required by law, when we believe that disclosure is necessary to comply with a judicial proceeding, court order, or legal process served on us and to defend against legal claims. We may also disclose your personal information to investigate the breach of an agreement.

Corporate Matters

We may disclose and share your personal information to explore and/or undertake a corporate transaction, including a merger, acquisition, amalgamation, IPO, reorganization or sale of RideShark and/or the Services. Your personal information will be used and disclosed solely for the purposes related to the transaction and will be protected by security safeguards appropriate to the sensitivity of the information.

We reserve the right to use anonymized and aggregated information for product development, research and advertising and marketing purposes. We may also disclose anonymized and aggregated information to third-parties.

  1. Retention of Your Information

So long as your Account remains active, we will preserve your personal information.

We will retain any and all personal information that we are required to retain under any applicable laws for the full duration of time required under those laws. We may also retain any anonymized and de-identified information and continue to use this information in accordance with this Policy.

Deleting your account

You can delete your account any time. When you delete your account, we delete things you have posted, such as your photos and trip profiles. If you do not want to delete your account, but want to temporarily stop having people find you for matches, you may set your profile to a visibility status of ‘No One’. To delete your account, simply click on Edit My Personal Info, select the Account option, and then Delete Account. Keep in mind that information you have shared with others is not part of your account and will not be deleted when you delete your account. This information includes communications, match requests or completed carpool details and any data to be retained due to legal or regulatory requirements.

Deleting your data

You can request us to delete the personal information we have collected from you. To request us to delete your information, simply choose ‘Contact Us’ from either the footer (Desktop app) or header (Mobile app) menu, and send us the form with your request. Following your request, we can delete your data unless they must be retained due to legal or regulatory requirements.

  1. Keeping Your Information Secure

Your personal information will be protected by security safeguards appropriate to the sensitivity of the information.

There is no guarantee against data breaches. In addition, no data transmission over the Internet can be guaranteed to be completely secure. However, we have taken reasonable measures to prevent a breach. In the event of a data breach, we will:

  • Notify users at the first reasonable opportunity of the breach; and
  • Immediately apply remedial measures.
  1. Cookies

We use “cookies” to collect information and improve the Services. A cookie is a small data file that we transfer to your computer or mobile device. We may use “persistent cookies” to save your user ID and login password for future logins to the website. We may use “session ID cookies” to enable certain features of the website, to better understand how you interact with the website and to monitor aggregate usage and web traffic routing on the website. You can instruct your browser, by changing its options, to stop accepting cookies or to prompt you before accepting a cookie from the websites you visit. If you do not accept cookies, however, you may not be able to use all aspects of our Services

We may use the data collected from “cookies” and web browsers for its own purposes, both related to and unrelated to improving our Services. In the event we disclose this data to any third-party for any purposes, it will be used anonymously and stripped of any and all personal or identifying information.
